This Privacy Policy is provided to you by My Dance Portal, LLC (“ MDP”, “ we” or “ us”) to describe the types of personal information MDP may collect about our you when accessing or using our Service (defined below), how MDP collects, processes, stores, and shares that information, and the rights our users have regarding control over that information.
The sharing of your personal information is voluntary. By using any part of the Service, you are indicating your acceptance to the terms of this Privacy Policy, and your acknowledgment that any personal information we collect from or about you through the Service will be handled as described in this Privacy Policy. If you do not agree to all of the terms set forth in this Privacy Policy, then you may not, and must not, access or use the Site, the App, or any other part of the Service .
Scope of this Privacy Polic y
This Privacy Policy applies to any information, content, or material you provide, as a Teacher, Student, or other type of user, through our website located at https://mydanceportal.com (including any associated websites linked thereto, the “ Site”), through the My Dance Portal software application available via the Site or via any mobile application offered by MDP (collectively, the “ App”), in connection with any services provided via the Site or the Service (collectively, the “ Service”), or otherwise provided directly to or collected by MDP or its third-party service providers, as set forth below.
Changes to this Privacy Policy
This Privacy Policy is current as of the “Last Updated” date set forth above. We may change this Privacy Policy from time to time, so please be sure to check back periodically. We will post any changes to this Privacy Policy, including any material changes, to the Site and the App. By continuing to use the Service after any such changes have been posted to the Service, you are indicating that you understand and agree to the terms of this Privacy Policy, as modified.
Types of Information We Collect
To provide the Service, we must process certain information about you. We collect this information directly from you, as well as from certain third parties and automatically through your use of the Service. We may combine information collected from or about you through any of these various sources. The types of information we collect will depend upon how you use the Service.
Information About You that We Collect Directly From You . Most of the information about you that we may collect will be collected directly from you, as explained below.
- Contact Information. You can opt to receive e-mail updates and newsletters from us by filling out our contact form, which requires you to provide us with your name and e-mail address. You may also choose to provide us with your phone number and include a short message in your contact form.
- Account Registration Information . You don’t need to create an account to access some features of our Service. For example, before creating an account, you can browse the Site and view user profiles and information on available Courses. In order to access and use certain other features of our Service, however—for example, in order to publish a Course as a Teacher or purchase and access a Course as a Student—you must first create an account with us. When you register for an account with the Service, you will be required to provide us with your name, e-mail address, and phone number. We also provide you with the ability to register for an account and sign in using your account credentials for your accounts with Facebook or Google. You understand and acknowledge that these third parties may share information with MDP if you choose any of these registration or sign-in methods, and that any sharing of that information is subject to the applicable terms and privacy policy of that third-party service provider.
- Profile Information . If you have a registered account on the Service, you will also be required to provide us with the following information, which we use for the purpose of connecting you with other users, as well as to verify your eligibility to use the Service and to improve certain features of the Service. This information includes a personal bio, an individual photograph of you, any social media handles you provide (including for youTube, Facebook, and Instagram), search tags (used to connect Students with Teachers according to your preferences), and favorite Courses (indicated by bookmarking the Course). You acknowledge that your profile information will be made publicly available via the Site.
- Transaction Data . We collect, receive and store certain information about you in connection with transactions processed via the Service or through our third-party service providers. For example:
- For Students: When you purchase a Course via the Service, we will receive and store the following information relating to that transaction: your Stripe Customer ID, Stripe Account ID, Stripe Transaction ID, amount charged, receipt, credit/debit card brand, expiration date, and last four digits of the card number used, and the status of the transaction.
- For Teachers: When you receive a Payout Transfer at the end of the month, we will receive the following information related to that transaction: the full amount transferred, the Transaction ID, and for each Student purchase transaction that month, referral information (for any purchase made through a referral), the relevant Course ID and related course information.
- Financial Information . In order purchase Courses via the Service, you will be required to provide us with certain information relating to the payment method you choose to use to make such purchases. The majority of your payment information is stored with our third-party payment process, but we do receive and store some of this information, including the brand of your credit/debit card, the card expiration date, and the last four digits of the card. As a Teacher, in order to be able to receive payments from us for your Courses purchased via the Service, you will be required to sign up for a Stripe Connect account; we therefore do not connect any deposit account information directly from you. For more information regarding how we use the financial information you provide to us, please see “ Payment Processing” below.
- Content You Post to or Transmit via the Service. We collect information about you through the content, communications, and other information that you post directly to the Service, such as your Courses (as a Teacher) or posted Reviews (as a Student). This includes additional information about the content you provide (like metadata), such as the location of a photo or the date a file was created. We also collect content that you upload via the Service, such a Student’s homework, lessons, course notes, essays, tests or quizzes, etc. Our systems automatically process content and communications you and others provide to analyze context of the content for the purposes described below ( see “How We Use Your Information” below). You acknowledge that the content you post to the Service, including the information you provide regarding a particular Course you’ve published (as a Teacher) and any posted Reviews (as a Student), will be available to other users of the Site and that we cannot prevent such users from using any of your posted content in a manner that would violate this Privacy Policy, applicable law, or your personal privacy.
- Inquiry and Feedback Information. You may share certain information to MDP by e-mailing us questions, feedback or other comments, to the extent we provide such functionality at any time.
- Notification Information. We may send periodic e-mails to you, including newsletters, promotional e-mails, updates regarding the Service or your user account, and requests for feedback or assessment. (To understand your options regarding opting out of these e-mails, see “ Opting Out of E-Mail Communications” below.) If you have consented to receive text/SMS notifications, we will also send you alerts and notifications related to the Service via this method. (To understand your options regarding opting out of these e-mails, see “ Text/SMS Message Consent and Opt-Out” below.)
Information About You Collected Automatically Through Our Service . Regardless of whether you create an account or provide any information to us directly via the Service, we will still automatically collect certain information about you, such as your IP address, geolocation (if enabled), device type, browser type and version, operating system, any links you click on via the Site, the dates and times you access the Service, the referral source, the duration of your visits, your page views and website navigation paths, as well as other information about the timing, frequency and pattern of your visits to the Site. (For more information, please see our “ Cookie Policy” below.) But we cannot link this information to an identifiable person unless and until you create an account with the Service.
Information About You that We Receive from Other Users of Our Service . We also receive and analyze content, communications and information that other people provide when they use our Service. This may include information about you, such as when a user posts a Review regarding one of your Courses (as a Teacher).
Information About You that We Receive from Third Parties . We may also collect information about you from third parties. For example, in order to use the Service as a Teacher, you will be required to create a Stripe Connect account (see “ Payment Processing” below), and we will receive your Stripe Connect ID. Further, if you register for or log into your account with MDP using your account credentials for a third-party service ( e.g., Facebook and Google), we will collect the account credentials for your account with such third-party site, and you are granting us access to personal profile fields stored by such third-party site. In addition, we may request access to other information stored with such third-party site, such as your contacts. We may store and process the information that we receive from third-party sites with other information that we collect from you or receive about you, but the applicable third-party site controls the information it collects from you. We have no control over how any third party uses or discloses the information it collects about you, and you acknowledge that it is your responsibility to review and understand the respective privacy policies of any such third-party sites.
Location and Geolocation Information. We may infer information about your location from the information that you provide to us directly or from your IP address. We may also obtain geolocation information about you ( e.g., through a third-party application that tracks GPS coordinates). We may use geolocation information for such purposes as improving the quality of the Service and the availability of the Service in your area. You can disable our access to your geolocation services by disabling location sharing in your browser or device settings. Doing so, however, may limit your ability to use certain features of the Service.
How We Use Your Information
MDP will not sell or rent to any third party any of the personal information or data that you provide to us. We will only use your information and data in a manner that is consistent with this Privacy Policy. If you provide personal information to us for certain specified purposes, we may use that information for those purposes, as follows.
Providing and Improving Our Service: to provide and maintain the Service; to improve the Service; to develop new features, products, or services; to perform technical operations, such as updating software; and for other customer service and support purposes.
Marketing and Communications: to communicate with you regarding your use of the Service, including to send you service updates; to respond to your inquiries or requests; to provide you with news and newsletters, and other information we think may interest you; and for other informational, marketing, or promotional purposes. Our communications with you may include communications via e-mail. Please see “ Opting Out of E-Mail Communications” below for more information about how to change your communications preferences.
Research and Analytics: to analyze how you interact with the Service; to monitor and analyze usage and activity trends; and for other research, analytical, and statistical purposes.
Protecting Rights and Interests: to protect the safety, rights, property, or security of MDP, the Service, any third party, or the general public; to detect, prevent, or otherwise address fraud, security, or technical issues; to prevent or stop any activity that MDP, in its sole discretion, may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity; to use as evidence in litigation; and to enforce this Privacy Policy or the terms of any agreement between you and MDP, including (without limitation) our Website Terms of Use , Terms of Service , and Teacher Terms.
Legal Compliance: to comply with applicable legal or regulatory obligations, including as part of a judicial proceeding; to respond to a subpoena, warrant, court order, or other legal process; or as part of an investigation or request, whether formal or informal, from law enforcement or a governmental authority.
How We Disclose or Share Your Information
We may disclose your information, including personal information, as described to you at the time of collection or disclosure or as follows.
Affiliates: We may disclose your information to current or future affiliates or subsidiaries for research, marketing, and any other purpose consistent with this Privacy Policy.
Third-Party Service Providers: We may disclose your information to our vendors, service providers, agents, or others who perform functions on our behalf in order for us to provide the Service. (For more information, please see “ Third-Party Sites and Services”).
Business Transfers: We may disclose your information to another entity in connection with, including during negotiations of, an acquisition or merger, sale or transfer of a business unit or assets, bankruptcy proceeding, or as part of any other similar business transfer.
Protecting Rights and Interests: We may disclose your information to protect the safety, rights, property, or security of MDP, the Service, any third party, or the general public; to detect, prevent, or otherwise address fraud, security, or technical issues; to prevent or stop activity which MDP, in its sole discretion, may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity; to use as evidence in litigation; and to enforce this Privacy Policy or the terms of any agreement between you and MDP, including (without limitation) our Website Terms of Use , Terms of Service , and Teacher Terms.
Legal Compliance: We may disclose your information to comply with applicable legal or regulatory obligations, including as part of a judicial proceeding; in response to a subpoena, warrant, court order, or other legal process; or as part of an investigation or request, whether formal or informal, from law enforcement or a government official.
Aggregated and Anonymized Information: We may disclose your information for marketing, advertising, research, compliance, or other purposes, but we will ensure that any personally identifiable information we collect from you is first aggregated, anonymized, or otherwise de-identified.
Payment Processing
In order to process payments from Students, and in order to make sure that Teachers receive those payments, we use a third-party, PCI-compliant service to process all payments and bank transfers. This information is used only to make single payment requests, or to automatically process any future recurring payments, and is not stored on our servers. Our third-party payment processors are bound by contractual obligations to keep such personal information confidential and use it only for the purposes for which we disclose it to them. We are not responsible for any third-party payment processor’s use of the personal information they collect in connection with your financial transactions made via the Service.
We use Stripe to process payments from Students and to submit payments to Teachers via the Service. For information regarding Stripe’s payment processing procedures and privacy and security practices, please see:
- For Students: Stripe’s Checkout user Terms of Service and Privacy Policy; and
- For Teachers: Stripe’s Stripe Connected Account Agreement , which includes the Stripe Terms of Service and Privacy Policy.
You are responsible for compliance with these terms, as applicable to you, and any other terms applicable to a third-party processor that we engage in connection collecting or distributing any payment to you via the Service, provided that we notify you of such use in advance, whether directly or by means of requiring you to accept such third-party terms in connection with making or receiving any payment of fees to us.

By accessing or using any part of the Site or Service, you hereby consent to this Cookie Policy.
Cookies
We and our third-party service providers use cookies and other tracking mechanisms to track information about your use of the Service. We or our service providers may combine this information with other information, including personal information, that we collect about you.
Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate the Service, while others are used to enable a faster log-in process or to allow us to track your activities while using the Service. Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. We use cookies for the following purposes:
- Authentication : We use certain cookies that allow us to authenticate a user when visiting or browsing our Service. These cookies are essential to your ability to browse the Service and use its features.
- Status Verification : We use certain cookies that allow us to determine whether a particular user is logged into the Service. These cookies are essential to your ability to browse the Service and use its features.
- Personalization : We use certain cookies that allow us to store information about a user’s preferences and to personalize the Service for that user. These cookies provide us with information about the choices you while browsing. For instance, we may store your geographic location in a cookie to ensure that we show you a version of the Site or other features of the Service that is localized for your area. We may also store preferences such as your language, text size, fonts, and other customizable site elements, and to keep track of what featured products or videos you have viewed, in order to avoid repetition. The information these cookies collect will not personally identify you, and they cannot track your browsing activity.
- Security : We use certain cookies as part of the security measures we implement in order to protect our user accounts, including preventing fraudulent use of login credentials, and to protect the security of the Service in general. For example, we store your e-mail address and phone number in order to ensure that, when you access your account, you are indeed who say you are.
- Advertising : We use certain cookies in order to help us to display advertisements that will be relevant to a particular user. For example, for Students, these cookies will remember what subject area you are seeking tutoring services in and will enable us to recommend categories of study in line with your subject of interest. For Teachers, these cookies will remember your availability and suggest the best times that students may become available for you, in order to better monetize your use of the Service.
- Analysis : We use certain cookies in order to analyze the use and performance of the various areas and features of the Service. These cookies include your IP address, geolocation (if enabled), device type, browser type and version, operating system.
- Cookie Consent : We use certain cookies in order to store a user’s preferences in relation to the use of cookies more generally. When you initially access the Site or the App, you will have the ability to consent to the use of cookies, and we will continue to store this information in order to comply with your choice.
Clear GIFs, Pixel Tags and Other Tracking Mechanisms .
Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (also referred to as web beacons, web bugs or pixel tags), in connection with the Service to, among other things, track the activities users of the Service, help us manage content, and compile statistics about usage of the Service. We and our third-party service providers also use clear GIFs in HTML e-mails to our customers, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.
Third-Party Analytics
We use third-party analytics service providers in order to evaluate your use of and further improve the Service. We use these tools to help us understand use of, and to improve, the Service, performance, and user experiences. These entities may use cookies and other tracking technologies, such as web beacons or local storage objects, in order to perform their services.
For example, we use Google Analytics to collect information about your use of the Site. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of the Site. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. This data may include pseudonymous identifiers that can be connected to other data that we have about you.
You can opt-out of making your activity on the Service made available to Google Analytics by installing the Google Analytics opt-out browser add-on available at https://tools.google.com/dlpage/gaoptout . The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about website visits activity. By continuing to use the Service, you agree and consent to our implementation and features of Google Analytics that we use.
Advertising & Marketing
We use third-party advertising and market services like Facebook, Google’s ad services, MailChimp, and other ad networks and ad servers to deliver advertising about our Service on other websites and applications you use. The ads may be based on things we know about you, like your usage data and system data, and things that these ad service providers know about you based on their tracking data. The ads can be based on your recent activity or activity over time and across other sites and services and may be tailored to your interests.
Depending on the types of advertising services we use, they may place cookies or other tracking technologies on your computer, phone, or other device to collect data about your use of our Services, and may access those tracking technologies in order to serve these tailored advertisements to you. To help deliver tailored advertising, we may provide these service providers with a hashed, anonymized version of your email address (in a non-human-readable form) and content that you share publicly on the Service.
Other Third-Party Sites and Services
Our Service may contain links to certain third-party websites and may integrate with certain services offered by third parties. Below are the additional third-party service providers that may collect information about you through your use of the service. Any access to or use of such third-party sites or services is not governed by this Privacy Policy but instead is governed by the privacy policies of the respective third-party owners and operators thereof. We are not responsible for the information practices of such third parties.
- Google Cloud: website hosting and performance services
- Vimeo: Video hosting services (for Courses)
- SendGrid: E-mail services
- Algolia: Application search functionality
Security
We have taken steps to help protect the personal information we collect. Though no service is impenetrable, MDP uses industry-standard 128-bit SSL encryption when collecting and transmitting your information through the Service. Once information has been collected, we encrypt sensitive data in our database for added security.
No data security measures can guarantee 100% security, however. You should take steps to protect against unauthorized access to your device and account by, among other things, choosing a robust password for your account (if any) that no other person knows or can easily guess and by maintaining the privacy of your log-in credentials. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized activity.
Your Consent and Opt-Out Choices
At MDP, we want to ensure that you are fully aware of all of your choices regarding the information we collect about you. Every user of the Service is entitled to the following choices.
Opting out of E-mail Communications.
You may opt out of receiving e-mail communications from MDP at any time by clicking on the “Unsubscribe” link included in the footer of the e-mail or by e-mailing us here . Please note that it may take up to ten (10) business days for us to process opt-out requests. If you opt out of receiving e-mails, however, you may not be able to receive the benefits of certain features of the Service, and (in any event) we may still send you e-mails about your account or any service you have received from us.
Text/SMS Message Consent and Opt-Out.
If you choose, you can provide your mobile phone number to receive text message alerts and notifications and other information related to the Service. You agree that, by providing your mobile phone number you expressly consent to receive automated text messages from us to the mobile phone number provided. Messaging and data rates for your mobile service carrier may apply and you should therefore check the rates of your mobile carrier prior to consenting to this service. You can opt out from further text communications at any time by texting STOP to the SMS number used by MDP to contact you.
We may share your mobile phone number with service providers with whom we contract to assist us with the above activities, but we will not share your mobile phone number with third parties for their own marketing purposes without your consent. Text Messages are distributed via third-party mobile network providers and, therefore, we cannot control certain factors relating to message delivery. Depending on the recipient's mobile carrier, it may not be possible to transmit the text message to the recipient successfully; nor is content available on all carriers. We do not claim or guarantee availability or performance of this service, including liability for transmission delays or message failures.
Rights of California Residents
The California Consumer Privacy Act (CCPA) provides California residents with specific rights regarding their personal information. This section describes your rights and how you can submit your request to us.
Access to Information
You have the right to request that we disclose information about our collection and use of your personal information over the past 12 months, including:
- categories of personal information we collected during that period;
- categories of sources for the personal information we collected;
- our business purpose for collecting each category of the personal information;
- categories of the third parties with whom we share that personal information; and
- the specific personal information we collected about you.
Deletion
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
We may deny a deletion request where retaining the information is necessary for us or our service providers. For example, data may need to be kept to:
- complete a transaction for which we collected the personal information, such as (for Students) your payment of fees for purchased Courses;
- track consumer complaints or service issues;
- detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity;
- comply with a legal obligation; or
- enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
Submitting a Request
Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
The verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative of a California resident who wishes to make a request.
We may not be able to respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will ask you for the e-mail information that you used to interact with us or sign up for a loyalty, email or to make purchases to help verify your identity or authority to make the request and confirm that your information is in our system. Information provided to submit a request will only be used for request purposes.
Timing
We will endeavor to respond to a verified consumer request within 45 days. If we require more time, we will inform you of the reason and extension in writing.
We do not charge a fee to process or respond to a verified consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will provide explanation and a cost estimate prior to completing the request. You may only make a request for access or data portability twice within a 12-month period. To submit your request, please e-mail us at legal@mydanceportal.com .
Non-Discrimination
We will not discriminate against you for exercising any of your rights under the CCPA.
Do Not Track Disclosure
Under California law, website and online service operators are required to disclose how they respond to web browser “do not track” signals. My Dance Portal does not currently take actions to respond to Do Not Track signals, as a uniform standard for such response has not yet been established.
Similarly, California law requires website and online service operators are required to disclose whether third parties may collect personal information about their users’ online activities over time and across different sites when the users use the operator’s website or service. Third parties that have content or services on the Service, such as a social feature, analytics service, or an advertising network partner, may obtain information about your browsing or usage habits. We do not knowingly permit such third parties to collect any personal information from our Service for their own unrelated marketing or business purposes, unless you directly provide it to us and we provide it to them for that purpose with your consent.
Minors & Children
We recognize the privacy interests of children and encourage parents and guardians to take an active role in their children’s online activities and interests.
The Service is not intended for access or use by anyone under the age of 13 (a “ Child”). If you are a Child, you may not access or use the Service at any time, in any manner, and you may not submit any information to MDP via the Service or upload any content via the Service. MDP does not knowingly collect or post information provided by minors under the age of 13. If we learn that we have collected personal data from a Child or Minor, we will take reasonable steps to delete it.
If you are under the age of 16 but at least 13 years of age (a “ Minor”), you must have the express consent of your parent or legal guardian to do so, and your parent or legal guardian must have read, must understand, and must agree to the terms of this Privacy Policy. If you are the parent or legal guardian of a Minor who may have provided us with information without your knowledge or consent, please contact us here to request to have this information removed.
If you are under the age of 18 and have a profile on the Service, you may ask us to remove reviews or other content that you posted on the Site by writing to us legal@mydanceportal.com and providing as much detail as possible ( e.g., date and caption) as to the post(s) you want removed. Please note that processing your removal request does not ensure complete or comprehensive removal of content that you have posted to the Service.
